Thank you for mentioning @coloradomountainclub in your post or submitting your photos to the Colorado Mountain Club directly. We’d like to get permission to share your adventures with our incredible mountain community. With your approval, your photo could show up on our social media feeds or our website and in emails, newsletters, or advertisements.
Throughout this document “you” or “your” refers to the person who electronically executes this document.
Your electronic execution of this document constitutes your acceptance of the Terms and Conditions and your agreement that the consideration of the mutual promises and agreements is sufficient. This document is a contract.
By agreeing to these terms, you and Colorado Mountain Club, its successors, assigns, and designees (collectively referred to as “Colorado Mountain Club”, “we”, or “us”) will enter into the following agreement:
You will always own any content and information you post or share that mentions @coloradomountainclub or which you otherwise provide to Colorado Mountain Club (e.g. through social media sites, blogs, emails, or file sharing sites), including, but not limited to your name, likeness, comments, photos, videos, and other media (referred to as “User Content”).
Colorado Mountain Club will collect, store, or use personally identifiable information, such as your name, social media handles, or e-mail address (referred to as “Your Information”), that has been voluntarily submitted to us.
You give Colorado Mountain Club permission to use your User Content as follows: you grant to Colorado Mountain Club a license to reproduce, display, perform, distribute, and otherwise use your User Content in any way that has a connection with the Colorado Mountain Club. We can use your User Content for marketing purposes, including, without limitation, in Colorado Mountain Club websites, email, other customer communications, and in any commercial, personal, digital, print, social, or editorial projects now or any developed in the future.
This User Content license is non-exclusive, meaning you may use your User Content for your own purposes or let others use your User Content for their purposes. You also grant us a license to your User Content with the understanding that we do not owe you anything in connection with our use of your User Content currently or in the future.
Our license is perpetual, meaning that the license you grant us to your User Content lasts for an indefinite period of time, unless a written request for removal is made.
You will indemnify, hold harmless, and defend Colorado Mountain Club, its employees, volunteers, contractors, or other associated parties against any losses, liabilities, claims expenses (including attorney’s fees) arising out of your breach of any representation or warranty as stated above, any third-party claim regarding the use by Colorado Mountain Club of your User Content, or any action taken by you that is inconsistent with the rights identified in these Photo Usage Terms & Conditions.
We reserve the right to refuse to accept or share User Content for any reason. We may remove User Content for any reason. We are under no circumstances required or obligated to use your User Content.
We respect the intellectual property rights of others. Please notify us in writing, by email or mail to the address listed below, if you believe that submitted User Content has infringed your intellectual property rights.
The notification must include:
You acknowledge and agree that upon receipt and notice of a claim of infringement, we may immediately remove the identified Used Content without liability.
If we have taken down your User Content due to suspicion of copyright infringement, you may dispute the alleged infringement by sending a written communication by email or mail to the address below.
The dispute claim must include the following:
Even with proof that the infringement claim is false, Colorado Mountain Club reserves the right not to reinstate the User Content. We are under no circumstances required to use or obligated to use your User Content.
If someone notifies us that you have infringed upon their intellectual property rights, we will remove the User Content and use Your Information to contact you.

Any parts of these Terms & Conditions may be updated or changed at any time in the sole discretion of the Colorado Mountain Club and any such update or change shall constitute an amendment to this contract, to which you consent. It is your responsibility to read the Terms & Conditions in full and check our website for changes.
